3. commercial agreements

A client may also have a separate:

  • Proposal
  • Service agreement
  • Statement of work
  • Order
  • Contract
  • Retainer agreement
  • or similar commercial agreement with us.

Those documents govern matters such as:

  • Fees
  • Scope
  • Deliverables
  • Advertising budgets
  • Contract length
  • Cancellation
  • Payment terms.

These Terms govern use of the Fully Booked HQ application.

If there is a conflict between these Terms and a specifically negotiated written commercial agreement, the written commercial agreement will normally take precedence in relation to the relevant commercial matter.

4. account eligibility

You must be:

  • Authorised to use the account
  • Authorised to act for the organisation you represent where applicable.

You must provide accurate information.

5. account security

You are responsible for:

  • Protecting your login details

  • Preventing unauthorised account access
  • Immediately telling us if you believe an account has been compromised.

You must not share access with an unauthorised person.

6. client users

A client organisation may authorise one or more users to access its client portal.

The client is responsible for determining who should have access.

We may suspend or remove access where:

  • The client requests it
  • A user is no longer authorised
  • Security concerns arise
  • The account is terminated
  • These Terms are breached.

7. the service

Fully Booked HQ is designed to support the planning, operation and measurement of local marketing and client acquisition.

Features may include:

  • Fully Booked Sprint tracking
  • Growth Partnership management
  • Client actions
  • Strategy
  • Client Brain
  • Voice Mining
  • AI Engine
  • Content planning
  • Script generation
  • Approvals
  • Meta advertising information
  • Instagram information
  • Lead management
  • Business metrics
  • Reports
  • Market Pulse
  • Other related functionality.

Features may change as the product evolves.

8. ai-assisted features

Fully Booked HQ uses artificial intelligence to assist with activities such as:

  • Organising business information
  • Analysing Voice Mining
  • Generating content ideas
  • Drafting scripts
  • Producing talking points
  • Generating calls to action
  • Identifying performance insights
  • Summarising market information
  • Drafting reports.

AI outputs may contain mistakes, omissions or unsuitable recommendations.

AI output is not automatically treated as final.

Users remain responsible for reviewing information before relying on, publishing or acting upon it.

9. regulated content

Fully Booked HQ may be used by businesses operating in regulated sectors.

AI-generated or platform-generated content does not constitute regulatory approval.

Clients remain responsible for:

  • Legal review
  • Compliance approval
  • Financial-promotion approval
  • Industry-specific disclosures
  • Substantiating marketing claims
  • Obtaining any required approval before publication.

This is particularly important for sectors such as:

  • Financial services
  • Mortgages
  • Insurance
  • Healthcare
  • Legal services
  • Other regulated industries.

10. no guarantee of marketing results

Marketing results vary.

Fully Booked HQ does not guarantee:

  • A particular number of leads
  • A specific cost per lead
  • A specific number of followers
  • A particular advertising return
  • A specific level of revenue
  • Business growth
  • Customer acquisition
  • Any particular commercial outcome.

Metrics may be influenced by:

  • Advertising budgets
  • Market conditions
  • Competition
  • Customer demand
  • Client responsiveness
  • Sales processes
  • Platform changes
  • Attribution limitations
  • Business capacity
  • Other factors outside our control.

11. performance data and attribution

Fully Booked HQ may combine information from:

  • Lead records
  • Client input
  • Marketing systems
  • Business metrics
  • Other sources.

Advertising and attribution data may be incomplete or subject to platform limitations.

Metrics should therefore be interpreted as decision-support information rather than a perfect representation of causation.

Where Fully Booked HQ displays assisted attribution, platform attribution or inferred relationships, this does not necessarily mean that a specific marketing activity caused a particular commercial result.

12. meta, facebook and instagram

Users may choose to connect Meta services.

By doing so, users authorise Fully Booked HQ to access the information covered by the permissions they approve.

The availability of Meta functionality depends on:

  • Meta APIs
  • Meta permissions
  • Meta platform policies
  • Account permissions
  • Access tokens
  • Third-party platform availability.

Meta may change, restrict or discontinue functionality.

Fully Booked HQ is not responsible for changes made by Meta that are outside our reasonable control.

Facebook and Instagram are products of Meta and are not owned by Fully Booked HQ.

13. third-party services

Fully Booked HQ may rely on or interact with third-party services.

These may include:

  • Lovable
  • Supabase
  • Meta
  • Instagram
  • Facebook
  • Firecrawl
  • AI model providers
  • Google Drive links
  • Google Meet links
  • Other software used in delivering client services.

Those services operate under their own terms.

We are not responsible for outages, changes, restrictions or failures caused solely by a third-party service outside our reasonable control.

14. market pulse

Market Pulse may analyse publicly available information from sources such as:

  • News websites
  • Industry websites
  • Public forums
  • Reddit
  • Regulatory sources
  • Other publicly available websites.

External information may be:

  • Incomplete
  • Incorrect
  • Outdated
  • Opinion-based
  • Context-dependent.

Market Pulse is designed to support research and content ideation.

It should not be treated as professional legal, financial or regulatory advice.

15. client data

Clients retain responsibility for information that they provide or lawfully control.

Clients grant Fully Booked HQ a limited right to process information where necessary to:

  • Provide the service
  • Operate requested functionality
  • Perform contracted marketing services
  • Maintain security
  • Comply with legal obligations.

We do not obtain ownership of a client's underlying business information simply because it is entered into Fully Booked HQ.

16. personal data provided by clients

Clients must not upload personal data unless they are lawfully permitted to do so.

Clients are responsible for:

  • Data protection notices
  • Lawful bases
  • Marketing permissions
  • Customer consent where required
  • Accuracy of customer data
  • Responding to relevant customer rights where the client acts as controller.

17. content ownership

Unless otherwise agreed:

Clients retain ownership of original business materials they provide.

Fully Booked HQ retains ownership of:

  • The platform
  • Software
  • Platform design
  • System architecture
  • Internal processes
  • Reusable frameworks
  • General templates
  • Underlying technology
  • Proprietary methodology.

Rights to specific bespoke marketing deliverables may also be governed by the client's commercial agreement.

18. platform licence

While your account remains authorised, we grant you a limited:

  • Non-exclusive
  • Non-transferable
  • Revocable
  • Licence to use Fully Booked HQ for its intended business purpose.

You may not:

  • Copy the application
  • Reverse engineer it
  • Resell platform access without permission
  • Attempt to bypass access controls
  • Access another client's information
  • Extract data by unauthorised automated means
  • Interfere with system security
  • Misuse third-party integrations.

19. acceptable use

You must not use Fully Booked HQ:

  • For unlawful activity
  • To impersonate another person
  • To send unlawful spam
  • To upload malicious code
  • To breach another person's privacy
  • To access data without authorisation
  • To publish knowingly false or unlawful material
  • To circumvent Meta or other platform rules
  • To violate intellectual-property rights
  • To interfere with the service.

20. client review and approval

Where Fully Booked HQ provides client-approval workflows, clients are responsible for reviewing content before approving it.

Approval may indicate that the client accepts:

  • The substantive message
  • Factual accuracy
  • Tone
  • Offers
  • Claims
  • Relevant commercial information.

Where separate regulatory approval is required, application approval does not replace that process unless expressly agreed otherwise.

21. service availability

We aim to keep Fully Booked HQ reasonably available.

We do not guarantee uninterrupted or error-free operation.

Temporary interruption may occur due to:

  • Maintenance
  • Updates
  • Security work
  • Hosting outages
  • Third-party APIs
  • Platform changes
  • Technical failures.

22. product changes

We may improve, modify, add, replace or remove application features.

Where practical, we will avoid materially disrupting active client delivery.

Third-party integrations may change because of changes outside our control.

23. fees

Access to Fully Booked HQ may be included within a client's service agreement or provided under another commercial arrangement.

Fees, payment schedules and advertising budgets are governed by the applicable commercial agreement rather than these general application Terms unless stated otherwise.

24. advertising spend

Unless expressly agreed otherwise:

Advertising platform spend is separate from our management or service fees.

Clients remain responsible for advertising costs charged by advertising platforms.

25. confidentiality

We will take reasonable steps to protect non-public business information provided through Fully Booked HQ.

Users must also respect confidential information they access through the platform.

Nothing in this section prevents disclosure required by law.

26. suspension

We may suspend account access where reasonably necessary because of:

  • Security concerns
  • Unauthorised use
  • Non-payment where applicable
  • Breach of these Terms
  • Legal requirements
  • Third-party platform restrictions
  • Risk to other users or the service.

27. termination

When a client relationship ends:

  • Platform access may be removed
  • Third-party connections may be disconnected
  • Certain data may be deleted or archived
  • Information required for lawful business records may be retained.

Data-handling following termination is also governed by our Privacy Policy.

28. disclaimer

Fully Booked HQ is a business and marketing operations platform.

Unless expressly stated otherwise, information within Fully Booked HQ is not:

  • Financial advice
  • Investment advice
  • Mortgage advice
  • Insurance advice
  • Regulatory advice.

Users should obtain appropriately qualified professional advice where required.

29. limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

This includes liability that cannot legally be excluded for:

  • Death or personal injury caused by negligence
  • Fraud
  • Fraudulent misrepresentation
  • Other liability that cannot legally be excluded.

To the fullest extent permitted by law, we will not be liable for indirect or consequential losses arising from use of Fully Booked HQ, including loss of:

  • Revenue
  • Business opportunity
  • Goodwill
  • Anticipated savings
  • where such loss is indirect or consequential.

Where liability may lawfully be limited and unless a separate written agreement states otherwise, our aggregate liability relating to the service will not exceed the fees paid or payable to us by the relevant client for the affected services during the 12 months preceding the event giving rise to the claim.

30. third-party platform changes

We are not responsible for losses caused solely by actions outside our control taken by third-party platforms such as:

  • Meta
  • Instagram
  • Facebook
  • Hosting providers
  • API providers
  • AI providers
  • where we have used reasonable care in operating our own service.

31. data protection

Use of Fully Booked HQ is subject to our Privacy Policy:

32. governing law

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction, subject to any mandatory legal rights that apply.

33. changes to these terms

We may update these Terms where:
